Chapter 6: Parenting Time and Access Rights
6.1 Parenting time Rights of the Non-Custodial Parent: Affirms residual custodial rights and a presumption of fitness for unsupervised access, extends parenting time where appropriate to immediate family members, and requires the custodial parent to facilitate a neutral, disturbance-free environment while permitting reasonable documentation of any interference.
6.2 Standard Parenting time Arrangements: Establishes the pathway to 50/50 shared residency through meaningful, functional contact that includes overnight stays, everyday parenting tasks, and age-appropriate gradual introduction of overnight time, subject only to proven safety risks.
6.3 Age, Holidays, Vacations and Special Occasions: Requires parenting-time arrangements to be developmentally calibrated, with frequent short contact for infants, progressive overnights for young children, substantial holiday blocks for school-age children, and fair alternation or sharing of festivals, birthdays, and significant occasions.
6.4 Weekend and Mid-Week Access: Mandates alternating weekends (typically Friday evening to Monday morning) and at least one mid-week evening or overnight stay to maintain continuous integration of the non-custodial parent into the child’s academic and daily routine.
6.5 School Holidays and Vacation Access: Directs equitable 50/50 division of major school breaks and grants travel rights (domestic or international) subject to prior itinerary sharing and non-interference with educational schedules.
6.6 Festivals, Birthdays / Special Occasions: Applies an alternating-year principle for major festivals, requires shared or exclusive time on the child’s birthday, and ensures the child spends time with a parent or grandparent on their own birthday regardless of the standing schedule.
6.7 Communication Protocols (Physical and Digital): Guarantees unimpeded daily digital access at fixed tele-visitation windows, immediate emergency notification, and the use of neutral CCTV-monitored contact centres together with court-approved shared-parenting applications to create transparent audit trails.
6.8 Disclosure of Child’s information: Obliges the custodial parent to share all routine, medical, educational, extracurricular, and health-related information, with immediate (within one hour) intimation of any hospitalisation or accident, so both parents can maintain continuity of care.
6.9 Distal Parenting time: Replaces weekly transitions with consolidated “Block-Time” for parents living beyond 100 km or abroad, allocates major vacation periods to the distal parent, mandates enhanced daily virtual access and portal credentials, and apportions travel costs proportionally (with relocation penalties where applicable).
6.10 Transportation and Handover Rules: Assigns collection and return responsibilities, requires neutral and safe handover locations, prohibits the use of transport logistics as an obstruction tactic, and directs that the child never be made a messenger or decision-maker in disputes.
6.11 Place of Parenting Time and Handover Venues: Prioritises child-friendly, non-adversarial locations (custodial residence for infants; neutral public or community venues for older children) and expressly discourages police stations or court corridors.
6.12 Provisions for Neutral Visitation Venues and Non-Traumatic Handovers: Prohibits hostile environments, mandates CCTV-equipped Community Transition Centres staffed by neutral professionals, introduces a 15-minute de-escalation rule against forced physical detachment, and imposes accountability for institutional failure to record complaints.
6.13 Terms of Parenting time: Empowers the court to frame interim schedules when mediation fails, emphasising child welfare, minimum meaningful duration, child-friendly venues, mutual variation rights, and supervision by a special officer where necessary.
6.14 Protocols for the Reintroduction of an Absent Parent: Presumes the possibility of re-bonding after long absence, prescribes a structured graduated schedule (digital to overnight within 8–12 weeks), limits supervised access to a maximum of 60 days, mandates reunification therapy, and imposes an affirmative facilitation duty on the custodial parent with compensatory time upon successful reintegration.
6.15 Parenting-Time Schedule: Sets out general child-centric principles, detailed age-banded schedules (0–36 months through adolescence), rules for festivals, birthdays and vacation travel, unmonitored digital-access protocols, and automatic compensatory time plus sanctions for gatekeeping or non-compliance.
